Terms of Service – Éirevia

These Terms of Service apply to all purchases made through Éirevia, a trading name and side business operated by Ruby Essentials.


Article 1 – Definitions

In these Terms and Conditions, the following definitions apply:

  • Cooling-off period: the period during which the consumer may exercise their right of withdrawal.
  • Consumer: a natural person who is not acting for purposes relating to their trade, business, craft, or profession and enters into a distance contract with the entrepreneur.
  • Day: calendar day.
  • Long-term transaction: a distance contract relating to a series of products and/or services, where the delivery and/or purchase obligation is spread over time.
  • Durable medium: any tool enabling the consumer or entrepreneur to store information addressed personally to them in a way that allows future consultation and unchanged reproduction of the stored information.
  • Right of withdrawal: the possibility for the consumer to withdraw from the distance contract within the cooling-off period.
  • Model withdrawal form: the standard European withdrawal form provided by the entrepreneur which the consumer may complete if they wish to exercise their right of withdrawal.
  • Entrepreneur: the natural or legal person offering products and/or services remotely to consumers.
  • Distance contract: an agreement concluded between the entrepreneur and the consumer within an organised system for distance selling of products and/or services, exclusively using one or more means of distance communication up to and including the conclusion of the contract.
  • Means of distance communication: any means that can be used to conclude an agreement without the consumer and entrepreneur being physically present together.
  • Terms and Conditions: these present Terms and Conditions of the entrepreneur.

Article 3 – Applicability

  1. These Terms and Conditions apply to every offer made by the entrepreneur and to every distance contract concluded between the entrepreneur and the consumer.
  2. Before the distance contract is concluded, the text of these Terms and Conditions will be made available to the consumer. If this is not reasonably possible, the entrepreneur will indicate before the contract is concluded where the Terms and Conditions can be viewed and that they will be sent free of charge upon request.
  3. If the contract is concluded electronically, the Terms and Conditions may be provided electronically in such a way that the consumer can easily store them on a durable medium.
  4. If specific product or service conditions apply in addition to these Terms and Conditions, the consumer may always invoke the provision most favourable to them in the event of conflicting conditions.
  5. If one or more provisions of these Terms and Conditions are wholly or partially invalid or unenforceable, the remaining provisions will remain in force.
  6. Situations not covered by these Terms and Conditions must be assessed in the spirit of these Terms and Conditions.

Article 4 – The Offer

  1. If an offer has a limited validity period or is subject to conditions, this will be explicitly stated.
  2. All offers are non-binding. The entrepreneur reserves the right to amend or adjust offers.
  3. The offer contains a complete and accurate description of the products and/or services offered. Obvious mistakes or errors in the offer are not binding on the entrepreneur.
  4. Product images are intended to provide a realistic representation of the products offered. However, actual colours may differ slightly from those displayed on screen.
  5. All prices listed on the website include VAT unless otherwise stated.
  6. Each offer contains sufficient information to make clear to the consumer what rights and obligations are attached to accepting the offer, including:
  • the total price including taxes;
  • any shipping costs;
  • payment, delivery, and execution methods;
  • whether the right of withdrawal applies;
  • the period during which the entrepreneur guarantees the price.

Article 5 – The Agreement

  1. The agreement is concluded at the moment the consumer accepts the offer and fulfils the conditions set out therein.
  2. If the consumer accepts the offer electronically, the entrepreneur will confirm receipt electronically without delay.
  3. The entrepreneur will take appropriate technical and organisational measures to secure electronic data transfer and online payments.
  4. The entrepreneur may, within legal limits, investigate whether the consumer can fulfil their payment obligations and may refuse an order for justified reasons.
  5. The entrepreneur will provide the consumer with the following information in writing or on a durable medium:
  • the business address for complaints;
  • information regarding the right of withdrawal;
  • warranty and after-sales service information;
  • payment, delivery, and performance details.
  1. All agreements are entered into subject to product availability.

Article 6 – Right of Withdrawal

For products

  1. The consumer has the right to withdraw from the agreement within 14 days without giving any reason.
  2. The withdrawal period expires 14 days after the day on which the consumer, or a third party designated by the consumer, receives the product.
  3. During the cooling-off period, the consumer shall handle the product and packaging with care and may only unpack or use the product to the extent necessary to determine its nature, characteristics, and functioning.
  4. To exercise the right of withdrawal, the consumer must notify the entrepreneur within 14 days of receiving the product by email or by using the model withdrawal form.
  5. The consumer must return the product within 14 days after notifying the entrepreneur of the withdrawal.
  6. The consumer must provide proof of timely return shipment.

Article 7 – Costs in Case of Withdrawal

  1. The direct costs of returning the product shall be borne by the consumer.
  2. The entrepreneur will reimburse all payments received from the consumer, including standard delivery costs, within 14 days after receiving the returned product or proof of return shipment.
  3. Refunds will be made using the same payment method used by the consumer unless agreed otherwise.
  4. The consumer is only liable for diminished value resulting from handling beyond what is necessary to establish the nature and functioning of the product.

Article 8 – Exclusion of the Right of Withdrawal

The entrepreneur may exclude the right of withdrawal for products:

  • made according to the consumer’s specifications;
  • clearly personalised;
  • unsuitable for return due to hygiene reasons once unsealed;
  • liable to deteriorate or expire rapidly;
  • whose price depends on financial market fluctuations;
  • sealed audio/video recordings or software once unsealed.

The exclusion applies only if clearly stated before concluding the agreement.


Article 9 – Prices

  1. During the validity period stated in the offer, prices will not be increased except for VAT changes or legal requirements.
  2. Prices linked to fluctuations in financial markets may vary.
  3. All prices are subject to typographical and printing errors.
  4. The entrepreneur is not liable for incorrect pricing caused by obvious errors or system malfunctions.

Article 10 – Conformity and Warranty

  1. The entrepreneur guarantees that the products comply with the agreement, the specifications stated in the offer, and reasonable standards of usability and reliability.
  2. Any warranty provided does not affect the consumer’s statutory rights under applicable consumer protection laws.
  3. Defects or incorrect deliveries must be reported within a reasonable time after discovery.
  4. The warranty does not apply if:
  • the product has been modified or repaired by the consumer or third parties;
  • the product has been improperly used;
  • damage results from failure to follow instructions or misuse.

Article 11 – Delivery and Execution

  1. The entrepreneur will exercise the greatest possible care when processing and executing orders.
  2. Delivery will be made to the address provided by the consumer.
  3. Accepted orders will be executed within 30 days unless a different delivery period has been agreed.
  4. If delivery is delayed or impossible, the consumer will be informed as soon as possible.
  5. In case of cancellation due to non-delivery, payments will be refunded within 14 days.
  6. Risk of damage or loss transfers to the consumer upon delivery.

Article 12 – Duration Transactions: Duration, Termination and Renewal

  1. Consumers may terminate agreements concluded for an indefinite period at any time with a notice period of no more than one month.
  2. Fixed-term agreements may not be automatically renewed for a fixed duration unless legally permitted.
  3. If an agreement lasts longer than one year, the consumer may terminate it after one year with one month’s notice.

Article 13 – Payment

  1. Unless otherwise agreed, payments must be made immediately upon placing the order.
  2. The consumer is obliged to report inaccuracies in payment details without delay.
  3. In the event of non-payment, the entrepreneur may charge reasonable costs in accordance with applicable law.

Article 14 – Complaints Procedure

  1. Complaints regarding the execution of the agreement must be submitted clearly and fully described within a reasonable period after the consumer discovers the issue.
  2. Complaints submitted to the entrepreneur will be answered within 14 days from receipt.
  3. If a complaint requires longer processing time, the entrepreneur will acknowledge receipt and provide an estimated response time.

Article 15 – Disputes

  1. These Terms and Conditions and all agreements between the entrepreneur and the consumer are governed by Dutch law unless mandatory Irish or EU consumer protection laws provide otherwise.
  2. The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply.

Article 16 – Additional or Deviating Provisions

Additional provisions or deviations from these Terms and Conditions may not be to the detriment of the consumer and must be recorded in writing or stored in an accessible manner on a durable medium.
